DeerTrack Terms of Use

1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you and DeerTrack ("we," "us," or "our") governing your access to and use of the DeerTrack mobile application and website (collectively, the "Services"). By registering an account or using the Services, you confirm that you are at least 16 years of age and agree to be bound by these Terms. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
2. Description of Services
DeerTrack is a platform for tracking and sharing wildlife sightings, managing friend connections, and applying for stalking licences. The Services are available on iOS, Android, and web browsers. Core features include:
- User registration and profile management
- Map view with pin/sighting placement and filtering
- Friend and invitation system
- Activity feed
- Stalking licence application
- Notifications and email communications
3. Account Registration
To access most features of DeerTrack you must create an account. You agree to:
- Provide accurate, complete, and current information during registration.
- Maintain the security of your password and not share it with third parties.
- Notify us immediately at legal@deertrack.app if you suspect unauthorised access to your account.
- Accept responsibility for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms or are inactive for extended periods, subject to prior notice where required by law.
4. User Conduct
You agree to use the Services lawfully and responsibly. You must not:
- Post false, misleading, or fraudulent sightings or information.
- Upload content that is unlawful, harmful, abusive, threatening, defamatory, or infringes third-party rights.
- Harass, stalk, or intimidate other users.
- Use the Services to facilitate any illegal activity, including poaching or unauthorised hunting.
- Attempt to reverse engineer, disassemble, or hack any part of the Services.
- Use automated tools (bots, scrapers) to access the Services without our prior written consent.
- Impersonate any person or entity.
- Circumvent any security or access controls.
5. Location Data and Maps
DeerTrack uses precise GPS location data to enable core functionality. By enabling location permissions, you consent to the collection and processing of your location as described in our Privacy Policy. You acknowledge that:
- Sightings and pins you mark as public may be visible to other users, including their associated location.
- You are solely responsible for the accuracy of location data you submit.
- DeerTrack is not responsible for any decisions made based on inaccurate location data.
6. Stalking Licence Applications
The stalking licence application feature within DeerTrack is provided as an administrative convenience only. DeerTrack does not issue licences and makes no representation regarding the approval, validity, or legal effect of any application submitted through the Services. You are solely responsible for:
- Ensuring the accuracy and completeness of any application data you submit.
- Complying with all applicable laws and regulations relating to stalking licences in your jurisdiction.
- Following up with the relevant licensing authority regarding the status of your application.
7. User Content
You retain ownership of any content you upload to DeerTrack ("User Content"), including photos, sighting descriptions, and profile information. By uploading User Content, you grant DeerTrack a non-exclusive, worldwide, royalty-free licence to use, store, display, and distribute your User Content solely for the purpose of operating and improving the Services. You represent and warrant that your User Content does not infringe any third-party intellectual property rights and that you have all necessary rights to grant the above licence. We reserve the right to remove User Content that violates these Terms or applicable law, without prior notice.
8. Intellectual Property
All intellectual property in the Services, including the DeerTrack name, logo, app design, software, and content created by us, is owned by or licensed to DeerTrack. Nothing in these Terms grants you a right to use our intellectual property except as necessary to use the Services in accordance with these Terms.
9. Third-Party Services
The Services may integrate with or link to third-party services (such as map providers or App Store platforms). These third parties have their own terms and privacy policies, and we are not responsible for their practices. Your use of third-party services is at your own risk.
10. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. DeerTrack does not guarantee the accuracy, completeness, or reliability of any sighting data, maps, or wildlife information provided through the Services.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DEERTRACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) EUR 100. NOTHING IN THESE TERMS LIMITS OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR ANY LIABILITY THAT CANNOT BE EXCLUDED BY LAW.
12. Indemnification
You agree to indemnify and hold harmless DeerTrack, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the Services, your User Content, or your violation of these Terms or applicable law.
13. Termination
You may terminate your account at any time via the account settings in the app. We may suspend or terminate your access to the Services at any time for any reason, including breach of these Terms, subject to providing reasonable notice except where immediate action is required for security or legal reasons. Upon termination, your right to access the Services ceases. Provisions of these Terms that by their nature should survive termination shall continue to apply, including intellectual property, disclaimers, limitation of liability, and dispute resolution.
14. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the European Union and the laws of the country in which DeerTrack is registered, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to the competent courts of the jurisdiction in which DeerTrack is registered. If you are a consumer in the EU, you may also make use of the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or prominent in-app notice at least 30 days before the changes take effect. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and may request account deletion.
16. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and DeerTrack regarding the Services.
- Severability: If any provision of these Terms is found invalid or unenforceable, that provision will be modified to the minimum extent necessary, and the remaining provisions will continue in full force.
- No waiver: Failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it in the future.
- Assignment: You may not assign your rights or obligations under these Terms without our prior written consent.
